The Divorce Process in Oklahoma

Every divorce is unique, and understanding the differences is crucial. We offer detailed guidance on the differences between contested and uncontested divorces:

Contested divorce: When spouses cannot agree on critical issues such as child custody, asset division, or alimony, a contested divorce process unfolds. This involves filing a verified Petition for Divorce, undergoing discovery, and waiting for a court date. The court will ultimately decide on the matters based on what it deems fair and just. Due to its nature, a contested divorce can be time-consuming and costly, depending on case details.

Uncontested divorce: In scenarios where spouses are in agreement on all key issues, an uncontested divorce offers a simpler route. This process involves filing a verified Petition for Divorce and drafting a decree aligned with agreed terms, which is then presented to the court for approval. Typically, this pathway is less complicated, more cost-effective, and quicker.

Our attorneys are committed to helping you identify the most suitable path for your unique situation, helping you make clear and informed decisions every step of the way.

Eligibility to Divorce in Oklahoma

In Oklahoma, eligibility for divorce is governed by both residency requirements and acceptable grounds for divorce.

To file for divorce in the state, at least one of the spouses must have been an actual resident in Oklahoma for a minimum of six months immediately preceding the filing. Additionally, they must reside in the county where the divorce petition is filed for at least 30 days.

Despite being a no-fault state, Oklahoma recognizes both fault-based and no-fault grounds for divorce. Oklahoma law recognizes multiple grounds for divorce, allowing couples to legally terminate their marriage based on either no-fault or fault-based reasons:

No-Fault Grounds

The most common ground cited for divorce is incompatibility, often called "no-fault" or "irreconcilable differences," where neither spouse is required to prove wrongdoing. This simply means the couple has irreconcilable differences, making the marriage unsustainable.

Under this ground, neither spouse is required to prove that the other did anything wrong, which makes it a less contentious route and simplifies the legal process. This option is often selected by couples looking for a mutually agreeable separation without the need for extensive court battles.

Fault-Based Grounds

While fault-based grounds often require additional legal proof and can lead to more contentious proceedings, they are available for those situations where severe issues have led to the marriage's dissolution.

For those cases where specific actions or behaviors have led to the breakdown of the marriage, Oklahoma law provides several fault-based grounds for divorce, including:

  • Adultery: Infidelity by one spouse can serve as a legitimate reason for divorce, requiring evidence to support the claim.

  • Abandonment: If one spouse abandons the other for a period of one year or longer, this can be used as a ground for divorce.

  • Cruelty: Physical or mental cruelty that makes life unbearable for the other spouse is another valid ground.

  • Habitual drunkenness: Regular and excessive alcohol consumption that negatively affects the marriage can justify a divorce.

  • Impotence: If one spouse is permanently incapable of consummating the marriage, this can serve as grounds for divorce.

  • Felony conviction: A spouse's incarceration due to a felony conviction can also be a reason for divorce.

Understanding the eligibility requirements and grounds for divorce is necessary for initiating the process correctly. Experienced family law attorneys, such as the attorney at Boettcher & Drummond, can give advice on the legal prerequisites so the process begins on a solid legal footing.
