What Is a Will?
A will is a legal document that explains how and where to distribute your assets after you die. Wills typically need to go through a process called probate to ensure the will is accurate and followed exactly as you’ve specified. Wills allow you to transfer property, heirlooms, and funds to whomever you choose and can also be used to detail your funeral arrangements.
What Is a Trust?
Unlike a will, a trust can take effect as soon as it is formed, not after you’ve passed. There are two main types of trusts—a living trust and a testamentary trust. Both versions are a method of transferring your estate to family, friends, or charity, much like a will, but trusts do not have to go through a probate process because a third party, or trustee, distributed them for you.
What Is Probate?
Probate is the legal process of distributing assets stated in a will after death and ensuring taxes and debts are paid to the rightful parties. It is basically a supervisory process to ensure your wishes are being followed exactly as you’ve expressed. There are multiple steps involved with the probate process and it can be overwhelming to do it alone, which is why we recommend hiring a probate attorney.
